How the USPTO process works

Here is the road a federal trademark takes:

  1. Search — check that nobody already uses a similar mark for related goods or services.
  2. Apply — file online with the USPTO, pick your classes, describe your goods or services, and pay the fee per class.
  3. Examination — a USPTO examining attorney reviews it. This usually takes months. They may send an office action asking for changes.
  4. Publication — the mark is published so anyone who objects can oppose it.
  5. Registration — you receive your registration and may use the ® symbol.
  6. Keep it alive — file proof of use between years 5 and 6, and renew every 10 years.

A business owner in the United States may file their own application. Fees and rules change, so always check the current figures at uspto.gov before you file.
