Trademark

Check your name, choose your classes, and prepare your own USPTO filing. This is education and guidance, not legal advice — for anything tricky, talk to a trademark attorney.

Lesson 5 of 7

Show your use (specimen and basis)

You file on one of two main bases:

  • Use in commerce — you are already selling under the name. You must show a specimen: proof of the mark as customers see it, like a product label, a website page with the name and a way to buy, or a sign at your business.
  • Intent to use — you plan to use it soon. You file now to hold your place and show use later (with added filings and fees).

A mock-up, an invoice by itself, or a business card alone is usually not an acceptable specimen. Ask your coach what would count for your business.
